I Feel Guilty, Should I Just Plead Guilty?
No. Never. Don't even think about pleading guilty right away.
Moral guilt does not mean you are legally guilty.
The prosecutor must prove beyond a reaonsable doubt that you commited the offence you are charged with. Each element of the offence you are charged with must be proven beyond a reasonable doubt.
There are numerous defences that an experience lawyer can use to present reasonable doubt to an unbiased court.
Furthermore, while you may feel you are morally guilty, your rights under the Canadian Charter of Rights and Freedoms may have been infringed and as a result, you would be entitled to certain remedies at trial (such as exclusion of evidence or a stay of proceedings).
Never plead guilty without speaking to an experience criminal lawyer who has reviewed your disclosure and has had a meeting with the prosecutor.
